    Significanct Features of the Ḥanafī Criminal Law

    Abstract:

    The most distinctive feature of Ḥanafī criminal law is its classification of rights which determines the legal consequences of various crimes. Thus, the three kinds of rights – the rights of God, the rights of the ruler and the rights of individual – divide crimes into ḥudūd, siyāsah and ta‘zīr. The standard of proof for the ḥudūd punishments as well as the nature and extent of these punishments cannot be altered by the government as they relate to the rights of God. The qiṣāṣ punishment relates to the joint right of God and individual which is why it reatains some characteristics of the ḥudūd as well as those of the ta‘zīr. Thus, its standard of proof cannot be changed but it can be pardoned or compounded by the victim or his legal heirs. Ta‘zīr punishment may be pardoned by the affected individual, while siyāsah punishments, being related to the right of the government, may be pardoned only by the government. In the domain of siyāsah, the government may make detailed laws, within the parameters of the general principles of Islamic law for the purpose of defining various crimes, fixing the forms and limits of punishments for these crimes and prescribing the standard of proof for them.

    Comparison of Impact of Macroeconomic & Bank-Specific Variables on Pakistan’s Islamic & Conventional Banks’ Profitability

    Abstract:

    This study examines comparison of how profitability of firms, in the Islamic Banking & Conventional Banking of Pakistan, is influenced to nominated financial and economic indicators, i.e. Liquidity, GDP, Inflation, Capital Adequacy & Size of the firm. For this purpose, the authors select five leading Islamic banks and seventeen conventional banks & choose annual data from 2009 to 2018 to study the behavior of dependent variables toward independent variable i.e. Return On Asset. By employing Panel Regression, the author concluded that macro-economic variables have insignificant impact on profitability of both types of banks. Size has found significantly negative impact on profitability of Islamic banks. The authors have also found that liquidity has a significant and positive impact on Islamic banks whereas liquidity and capital adequacy have significantly negative with conventional banks’ profitability. The conclusions will be helpful for the banking sector to implement their policies accordingly in order to generate more profit in future.

    Role of Religious Coping in Parenting a Child with Down Syndrome

    Abstract:

    To the extent that Allah tests us that much he adored us, partially in the light of the fact that it pacify our sins. A large no of studies proposes that individuals frequently go to religion when facing upsetting or stressful life occasions. Parenting a child is filled with a lot of challenges. These challenges intensify when the child to be taken care of has some physical and mental deficiencies. All the prophets likewise experienced occasions of extraordinary hassles and stress, through such experiences they gradually remind Allah and make peace in recalling him. Training likewise pursued by our cherished Prophet. Thus the aim of this study is to explore the relationship of religious coping with stress, depression and anxiety, in parents having children with Down syndrome. Through purposive sampling 200 adults, having children with Down syndrome were recruited. The combination of Urdu version of Brief Religious Coping Scale6 and Depression, Anxiety, Stress Scale5 were used to assess religious coping and parental distress of the selected participants. It was hypothesized: Inverse relationship exists between Positive religious coping and Psychological distress level in parents having children with Down syndrome. Whereas direct association exists between parental Psychological distress level and Negative religious coping mechanisms. Pearson Product Moment Correlation Coefficient was analyzed to get the results and confirmed the hypotheses. The findings categorically suppose that through grounded association or stronger connection with Almighty Allah is a valuable coping in stress acknowledge by parents or guidance’s of those children with Down syndrome.

    Abstract:

    The phenomenon of the presence of Muslims all over the world by naturalization and migration is being understood in terms of a new concept, “Transnational Islam” for the united Muslim Ummah. The sense of the unity of Muslim Ummah has been always integral to Muslim conscience throughout the ages. Transnational Islam, it is expected, being a modern rubric, will create, on one side, the sense of oneness of Ummah in the presence of so many nationalities and, on the other, loyalty to individual countries. It would be helpful to face multi-dimensional challenges posed by the modern world for Muslims and humanity. To face and overcome the impending challenges, the Muslims need to study their current phenomena afresh but in the light of the teachings and spirit of the Qur’an and Sunnah. They also need to come up with a realistic and practical framework. This proposal, therefore, identifies obstacles and suggests as solution, the regeneration of the revivalist intellectual tradition of Islam and its framework.

    Resistance to British Cultural Imperialism in the Poetry of Allama Iqbal and W.B. Yeats

    Abstract:

    The article examines the views of Allama Iqbal and W.B. Yeats, against British Cultural imperialism. Through juxtaposing the poets from two different languages, different religious and cultural backgrounds, identical resistance has been traced against British colonizers’ cultural expansion through religion, education, denouncing local history, and anglicizing social norms. It adds slightly to existing scholarship on comparative literature, literature of resistance, and post-colonial literature. To make a comparison of both poets, Zepetnek’s model of thematic inclusion has been followed. It has been concluded that, despite racial, religious, and linguistic differences, the poetic resistance to alien culture by both poets has been almost similar, and natural agreement in their perspectives exists.

    Abstract:

    The need of integrated curriculum was raised by the pioneer of the movement of Islamisation of Knowledge (IOK). This article seeks to analyse a few reflections on the attempts towards integrated Islamic curriculum to see its relevance. To achieve this, an overview of IOK is presented analysing the central ideas carving the issue of integrated curriculum. The experience of IOK in IIUM, integrated Islamic Curriculum in selected Malaysian Islamic schools, and integration practices in selected educational institutions in Indonesia and Brunei are also explored and analysed to highlight the relevance or irrelevance of the attempts based on qualitative method of content analysis. Recommendations on how to develop an integrated Islamic curriculum relevant to our time in disciplines such as English, Mathematics and Medical sciences have been made.

    Abstract:

    According to Britannica on line Encyclopedia”A welfare state is a form of government in which the state protects and promotes the economic and social well-being of citizens, based upon the principles of equal opportunity, equitable distribution of wealth, and public responsibility for citizens unable to avail themselves of the minimal provisions for a good life. The first and foremost policy of a welfare state is to provide basic facilities equally to all its citizens. Post-modern world is trying to gain a selective mechanism to reinstate the system of welfare as a political and economic theory. Most of Western welfare states establish ideas of Marxism, while the Islamic welfare state is based on teachings of Quran and Sunnah. The major difference between a western welfare state and an Islamic welfare state is based on the economic factor. Western theory of a welfare state is the theory of economic progress, while in an Islamic welfare state, the economic factor is just a part of a comprehensive system. According to some critics, the idea of an Islamic welfare state is obsolete because they believe that the codes and conducts used to establish an Islamic welfare state are no longer active. They think that Islamic laws the time of Prophet Muhammad (peace be upon him) are no longer applicable to modern societies today. The aim of this research is to explore the differences between an Islamic and a Western welfare state and their socio-economic patterns, besides providing an answer to critics of the concept of Islamic welfare state. This study also focuses on the approach of orientalists and their critique on Islamic state theory and practice. This research is qualitative. Data has been collected through comprehensive research, that involved reading of research journals, History and other relevant material.

    Abstract:

    This article focuses on Imām Abū Ḥanifa’s methodology to deal with Khabar-e-Wāḥid in terms of derivation of jurisprudential issues. It is concluded that Imām Abū Ḥanifa had strict merits while accepting Khabar-e-Wāḥid. He mandated some conditions to accept Khabar-e-Wāḥid. The most important conditions include that it should not contradict with Qur‘ān and Sunnah (Mashhorah) and the narrator should not act against his narration and must not issue any verdict contrary to it. Moreover, it should not relate to the aspects that are needed by the general public (‘Amom-e-balwa) and it should not contradict with al-qiyās, if the narrator is not a Faqih, it should not be out of reference and out of practice during the reign of the Companions of Holy Prophet Muhammad (peace be upon Him). The article presents these conditions in a lucid manner, concluding the precisest methodology of Imām Abū Ḥanifa for Khabar-e-Wahid.

    Abstract:

    As to the Fictional argument with Aḥādīth, the reasoning of those Aḥādīth is of the same importance as the reasoning of Qur‘ānic verses for understanding the exact meanings of the Holy Qur‘ān. From the earliest period of the Ummah, muḥaddithin dealt with this topic with an extra significance. Hazrat Ayesha Siddiqah (May Allah be pleased with her) did not acknowledge a few Aḥādīth as their narrators did not know the exact reasoning of Aḥādīth. She pointed out some errors that occurred in some cases by the companions in the narration of some Aḥādīth and corrected these errors with respect to Ḥadīth reasoning which is discussed briefly in the article. This topic gained some extra attention from the researchers in the fourth century. The article comprehensively brings the relevant discussion with respect to the need of the present age.

    Abstract:

    Human beings need Allah's guidance for the successful life. For this Allah sent chain of His messengers with the teachings that could be followed by the people for coming closer to Allah. After the keen study of the teachings ordained by Allah, it reveals that its purpose is to divert attention of people to the mystic knowledge of Allah, and make people to come out of the trifling of fake gods and bow down them before only one God and put them on the right path in spite of different tangled tracks. For gaining this purpose the way of divine wisdom and preaching, people were guided to the orders which can be easily acted upon. If we study the orders which were implemented in the Prophetic periods of Makkah and Madina, we can easily judge that the Prophetic wisdom kept in view the convenience of the people in sharī‘ah issues. By studying the sharī‘ah issues, two things become prominent with reference to time and circumstances; one for the implementation of orders strategy of graduation was adopted. And secondly system of abrogation was managed too for the implementation of orders. Deep study of these two issues leads us to the observance of time and circumstances. For example In worship issues; prayer, fasting, Hajj and Zakat, similarly in the context of daily life dealings with the reference of time and circumstances graduality and abrogation were adopted. Therefore, in sharī‘ah issues Prophetic wisdom like expansion and convenience instigate us for the observance of time and circumstances, because of this our issues can be solved out and people may act upon sharī‘ah conveniently. Parting from this will be great hindrance for the Serving of Religion.

    Abstract:

    Stock exchange is an important institution of capital market on any economy. Past two decades of Islamization of financial system created a demand for providing conducive financial ecosystem for Islamic financial system. Financial deepening is priority of any economy and providing Islamic alternatives to financing share trading will be a good step towards broadening the scope of Islamic financial services to capital market. This paper discusses Islamic alternatives of financing of share trading in stock market both from banking system and brokerage houses. It also suggests possible modes of financing that can be used as a flexible alternatives of conventional products.

    Almighty Allah has created the human being, guided him towards the Right Path and acquainthim with the concept of Reward and Punishment. A wise person efforts to obey the locus guided by the Allah Almighty. The abilities to: surrender oneself before the commands of Allah; build character including both the apparent as well as the veiled; explore the facts, take keen interest in Eibadah, prefer the Hereafter upon the Here; and far-reaching trust in Allah lead toTaqwah. When a person strictly abides by the limits delineated by the Shariah and refrains from the prohibited, he includes himself among the Mutaqeen and this is the best way to get success before Allah. Lives of SuffiahKarams are the practical demonstration of avoiding the sins, clean the hearts and adornment of virtues. Adoption of Taqwah is the only assurance of success before Allah.

    Abstract:

    Civilizational Studies had been an important trend in Social Sciences during the past two centuries. Historians, sociologists, anthropologists and philosophers had dedicated their researches to investigate the origin, dynamics and reasons of rise and decline of world civilizations. Muslim intellectuals had also rehearsed to study the present and future of Muslim civilization in new world order where most of the Muslim countries were colonized by foreign powers and later achieved independence. Among many others, Algerian Malek Bennabi is one such prominent name, who is unfortunately not well read in this part of the world. Malek Bennabi with the academic background of engineering, and natural sciences had coined his terminology for the study of civilization. Among his most important ideas on civilizations his equation of civilization comprising of man, soil and time, integrated men, colonizability, world of ideas are key features. In his equation of civilization, religion acts as catalyst thereby affecting the civilization in a very positive way. This article surveys the ideas and thoughts of Malek Bennabi on Islamic Civilization and its relevance in the contemporary Muslim world.

    There has been a lot of debate and discussion on the issue of Islamization of modern sciences among the muslim intellectuals.The traditional muslim scholars contend that hence all knowledge is from Allah, so there is no need to re-islamize it. The list of those who did their best in this issue of Islamization of modern sciences is not very long because the muslims have not taken this issue as serious as it has been or it is. However, some prominent intellectuals worked seriously to conceptulise this problem of the Muslim Ummah and the issue of Islamization of modern sciences as an epistemological and socio-political solution. Secularism and the great speed with which secularization has engulfed the Muslim world, has stirred the muslim intellectuals from their indifferences and motivated them to act. Despite the massive discussion and literature, Muslim scholars and intellectuals have not struck a common chord among themselves. This article aims to highlight some of those foremost muslim intellectuals who rendered their services in forming a possible policy with respect to the various interpretations of the concept of Islamization of knowledge, philosophical framework, and who gave a methodology for achieving the goals of Islamization. This paper not only gives introduction of these intellectuals but also explores the possibility of reconciliation between their ideas in the hope of further advancing the cause of Islamization of modern sciences.

    ’Ilm Al-Furōq is an auxiliary branch of Islamic jurisprudence, which eliminates scholarly doubts, differentiates the concepts and provides the ability to draw the conclusions. To differentiate between things and concepts is the very quality which enables the human society to become Ashraf al-Makhlōqāt; because of the very power and quality the human being recognizes and highlights the supreme position of Allah Almighty.This provides very basis of knowledge and Justice. The classical jurists had mentioned this element primarily; thereafter numerous books were attributed to this knowledge, some of them were even named it as Al-Furōq.     Abstract:

    It is often argued that most of the Ṣufis don’t record the ḥadīth accurately without properly documenting the text (matan) and the chain of narrators (sanad) of a ḥadīth. Therefore, most of the Prophetic traditions recorded in the ṣufi literature are not correct or fabricated. We have find that many leading hadith experts such as al-Subkī (d. 771 AH) and al-Irāqī (d. 806 AH) criticized the aḥadīth of al-Ghazālī (d.505 AH)’s Ihya Uloom al-Din and identified those which were baseless. This paper aims to conduct a critical study of this argument by analyzing some hadiths alleged to be incorrect and recorded in three important ṣufi manuals: Qut al-Qulūb by Abu Ṭālib al-Makkī (d. 386 AH), Iḥya’ ‘Ulōm al-Din by al-Ghazālī and Mathnawi by Rūmī (d. 672 AH). This study argues that although these aḥadīth are not correct according to the principles of hadith criticism but there are many similar authentic aḥadīth recorded in reliable ḥadīth sources. Therefore, a careful examination of the hadiths recorded in the ṣufi manuals in the light of riwayat bil-m‘ana improves their status because their text and chain are incorrect but their themes are accurate and present in the authentic aḥadīths.

    Abstract:

    It is the excellence of our Islamic scholars that they endeavored hard to bring Islamic jurisdiction in the contemporary emerging issues. Our history shines with the glitters of such great personalities. ‘Allāma Ghulām Rasōl Sa‘eedī was one of such figures whose narratives on various issues of the modern world are worthwhile. As we know that the rapid evolution of medical science has raised many issues that were never before the Muslim jurist in the last centuries. Medical science has encompassed all human life in entirely different way than past especially artificial and modern methods to birth of human being like artificial insemination. Artificial insemination is perhaps the most talked about issue of the modernistic world. There are two schools of thought in this concern, some favor it blindly and blatantly and the other raises strict objections on this view and relate it as anti-Islam element. ‘Allāma Sa‘eedī wisely bridged the gulf. This article deals with the reasoning of this new issue in the distinct inferring pattern by ‘Allāma Sa‘eedī.

    Abstract:

    In today's advanced world where man has all facilities and comfort of life, he is missing something day by day and that is the gracious gift of patience and prudence and kindness. Country to country, house to house extremism and violent behaviour is burning out the societies. These societies are not only destroying themselves, but they are ruining others too by wrecking peace and contention. Somewhere domestically women are victimized whereas, in some societies, men are targeted, and now youngsters and children are also encircled in this beastliness. In this research article, causes of violent behaviour are discussed and also definite solutions are provided. The article mainly discusses the violence against women and specifically domestic violence. Including all widely aspects of domestic violence, a comprehensive research is made on the causes, types, and respective attitudes. With some practical solutions to this particular extremism for both men and women, the article moves on to the description of violence amongst youngsters with a detailed discourse of the causes and aspects. A significant discussion is made for its remedial measures. The beauty of this research is that it also mentions the role of parents and other relations for resolving the violence and extremism amongst youngsters. The article concludes itself with some valid suggestions. If the solution presented in the article are worked out, it is hoped that society will get rid of such attitudes and it will turn into a cradle of peace and harmony.

    Abstract:

    The Sanusiyya movement is considered one of the most important revival movements that played a significant role not only in jihad through integration of Bedouin tribes of Libya and Sahara but also in revived Islamic science through reconstruction of Islamic knowledge. Shaikh Muhammad al-Sanusi, the founder of the Sanusiyya, was an established scholar in Islamic sciences who had composed significant writings on various dimensions of Islamic Sciences. This paper aims to understand the theory of Ijtihad of Shaikh Sanusi as described in his magnum opus Iqaz al-wasnan. He criticized the blind imitation and asserted that a Muhtahid should follow the Sunnah and Hadith in resolving the contemporary issues and blind following of established mazahib cannot be allowed for a jurist who knows the sources of Islamic law. He argued that blind imitation is only permissible for a layman and jurists must follow the hadith. This paper will help the reader to understand the ijtihadi thoughts of Shaikh Sanusi.

    Abstract:

    The Holy Qur'ān is the ultimate Divine guidance. Muslim scholars of all the times conveyed the meanings of the Qur'ān in different languages of the world with par excellence. In this research paper, an attempt has been made to analyze and introduce a unique Sindhī translation of the Qur'ān named "Bayān al Raḥmān fī Tarjumah al Qur'ān" by Sheikh ‘Abdul Waheed Jān Al Sirhindī. The article evaluates the methodology of the Sheikh critically and analytically in an objective manner. The distinction of this translation has been highlighted and the limitation of Sindhī language has also been pointed out in a lucid manner. The language used by the translator is easily comprehensible and transmits the themes of the Qur'ān to its addressees cohesively. It is worth mentioning that footnotes used by Shaikh for the complete understanding of the Qur'ān are effective, useful and of great importance for its readers.

    Abstract:

    Allah revealed the Qur‘ān in the Arabic Language. Therefore, Arabic Language stands superior as compared with any other language. Though, the language used in the Qur‘ān is entirely different from the modern Arabic. This research focuses on charisma of Al-Sheikh Ibn-e-‘Ashōr and the environment where he lived and learnt the various forensic sciences till he became a great scholar. This research mainly discusses the excellence of Al Tahrīr Wa Tanvīr. It also highlights his method of presenting miracles of the Holy Qur‘ān in the exegesis.     Abstract:

    One word expresses one meaning and at times multiple meanings too. This rule exists in the Arabic language and other languages as well. Selection of any specific meaning for a word in Arabic language is called “Semantics”. Usually, a meaning is related to Derivative origin, Linguistic use, Contextual use, Islamic Legal term or the Qur‘ānic term. One word does not always have multiple meanings all the time. Qur‘ānic words generally relate either the literal meanings like Names of Allah and His Attributes or other than literal meanings such as; (خزان, رحمة, رزق) and likewise. However, meaning of a word can also be observed by the supportive phrases and the same is the topic of this research paper. In order to observe a particular meaning of a certain word, there are many supportive phrases (قرائن و شواهد) such as contextually sequence, grammatically usage, synonyms, antonyms, deviation from the apparent and the predominant concept of Qur’anic words and sentences. All these six aspects must be observed to obtain any meaning of an Arabic word.

    Dramatics has been the prominent mean of expressing the feelings, emotions and sensation of human. A play may be based on a real story or on a fiction. It is a way of communication, mutual understanding, reconciliation, expressing ideas and a way of environmental awareness. The subject of ancient plays was confined to religious rituals, and from the expression of religious rituals to awareness of the social issues. History of dramatics shows that the Greeks, Indians and ancient Arabs have used this art to promote their religious rituals. However, now this art is consciously decorated with social problems and issues. For a long period, the central theme of Urdu plays has been fiction and historical stories, but Agha Mohammad Hasher Kashmiri transformed the face of drama from the fantasy world into awareness of real social problems. It is a fact that Urdu plays have contributed significantly in creating social awareness and promoting moral and religious values. Nevertheless, due to the influence of technology and commercial requirements, modern play has lost its standards.

    There are many points of view according to different vision but the natural phenomenon for research method is same. The scientific theories and approaches which analyzes the language from the linguistic structural approach, the method of composition, the dissociative approach, the semiotic method of today’s scholar especially in the field of modern and contemporary Arabic criticism is due to the spread of translation and increased area of friction with the languages used in the west. Some of the scholars think that they have introduced new theory and modern devices to the language, but the ancient scholars used the signs of science. According to the west scholars, science is not the exclusive domains of people without others, it is a communication between human beings. From the point of view of Arab scholars, I have summarized the discussion under these facts is: Definition of semiotic, the requirements of the curriculum, the difference between linguistic of sentence and speech, and the statements of renowned scholars in this field. More the need of the semiotic syllabus in our Arabic language also been highlighted. The contribution of Ancient Arab linguists’ strategies is helpful in the field of study Arabic Language. We hope that we should be able to look at the semiotic syllabus in an Arab spirit to show its features

    The topic of my research (املقارنة اللغوية الدراسات" (The Comparative linguistic studies between tafsir Al-Tahreer wa Al-Tanveer by Ibn-e-Ashoor and Tafseer Fathul Biyan do Maqasid-ul- Quran by Nawab Siddique Hassan)". I have selected the words from these exesies which are discussed linguistically.Then I have compared both the discussions. Finally I have added the discussions of some other famous eaegies, dictionaries and Encyclopedias. So that all the finding should be authentic and fruitful. I have also included the statement of the said eaegies where their point of view match and different each other.The writer of the first "Tafseer" is shaykh ul Islam Muhammad Tahir Bin Ashoor. He was born in 1879 Ad at Tunis. His forefathers were the most famous and pious people of Andlus. Ibn -e-Ashoor learn the Quran by heart at the age of 6 years only. Then he gained the knowledge of Arabic language. He got in admission in Jamia Zaitonia at age of 14 and learned all type of Islamic knowledge. After that he started teaching at the said Institute. He is the writer of a lot of books in which some books are printed while the others are non painted.The most famous books is name as "AlTahreer wa al-Tanvir" which is best tafseer of the Holy Quran. The writer of the second book "Tafseer Fateh ul Biyan" is Nawab Siddique Hassan Khan Al- Qanooji. He was born at Braili the city of India in 1823 AD.Then her mother took him to Qanooj. He is the most famous and popular scholar of India and is reknown all over the Islamic word.He wrote almost 200 books. But the most famous book is "Tafseer Fateh ul Byan" linguistic discussions are famous in this tafseer.I have compared the linguistic meaning of the difficult Arabic words of the Quran found in the both said "tafser "
